IMPORT- EXPORT REGULATIONS
One of the factors of influence that has a crucial impact in all of the commercialization activities of the country is the development of import and export regulations of the nation, so that it can be safe to create this norms, and also can make more attractive the option of maintaining commercial relations in Colombia, which is actually one important issue for the national industries.
Procolombia, that is one facilitator in this exchange between countries, and participates in the publication of the norms that will have an impact in different companies in Colombia.
These laws refer to the first created and established in 1991, which formally established the next: “Por la cual se dictan normas generales a las cuales debe sujetarse el Gobierno Nacional para regular el comercio exterior del país, se crea el Ministerio de Comercio Exterior, se determina la composición y funciones del Consejo Superior de Comercio Exterior, se crean el Banco de Comercio Exterior y el Fondo de Modernización Económica, se confieren unas autorizaciones y se dictan otras disposiciones”. (PROCOLOMBIA, p.p 1)
Which was later modified under the nest statement: “Modificada por la Ley 1004 de 2005, 'por la cual se modifican un régimen especial para estimular la inversión y se dictan otras disposiciones', publicada en el Diario Oficial No. 46.138 de 31 de diciembre de 2005”. (PROCOLOMBIA, p.p 1)
In one of the new deals that been established with other countries, one of the most important of all of them is the laws with United States, in that sense there are some formal norms that have to be respect, that are included next:
“Entidades que reglamentan en materia de medio ambiente:
• Administración para la Protección Ambiental (EPA)
• Administración de seguridad y Salud Ocupacional (OSHA) Aunque los gobiernos estatales y locales se reservan el derecho de imponer disposiciones reglamentarias más estrictas. EPA Administración para la Protección Ambiental: Estas normas son reconocidas internacionalmente, aunque el criterio en la mayoría de países es en relación riesgo / salud, en Estados Unidos el criterio es riesgo / beneficio. Estas regulaciones consisten en:
• Prohibir y/o limitar la entrada de productos.
• Establecer puertos específicos para el ingreso de mercancías.
• Aplicar normas para marcado y etiquetado de las mercancías”. (COLOMBIAN AMERICAN CHAMBER OF COMMERCE, p.p 44).
Considering this as an example of one the legal issues that one country has to accomplish, Colombia has to keep some norms that can bring some benefits to its industrial development, bringing some external investment of other countries.
